    Govt to Modify University Funding Model Following High Court Ruling.

    The government has announced plans to modify the current university funding model in response to a ruling by the High Court, which declared the policy unconstitutional and lacking legal backing.

    The decision was made after the court determined that the model had been implemented without proper public participation and that the categorization of students into different bands was discriminatory.

    The ruling has prompted the Ministry of Education to take immediate steps to rectify the issues raised.

    Unconstitutional Funding Model

    In a statement following the court’s ruling, Education Cabinet Secretary Julius Ogamba assured the public that the government is committed to ensuring the funding model is refined to comply with legal and constitutional standards.

    The model, which was introduced in 2023, has faced significant challenges, particularly regarding the categorization of students into different funding bands.

    Ogamba explained, “The funding model was introduced in 2023 and we are in the second year of its implementation, but it had a few challenges with respect to banding of the various students.”

    Working Party Committee to Address Issues

    To address these concerns, President William Ruto had earlier established a working party committee tasked with reviewing the funding model.

    Ogamba highlighted that the committee has already produced an interim report and is working on a final version that will guide future implementation.

    “The President also formed a working Party Committee to relook into the whole funding model and refine it to ensure that the next cohort does not face the same challenges that were seen during the admission of the current cohort,” Ogamba said.

    Commitment to Reform

    The Education Cabinet Secretary emphasized the government’s commitment to ensuring that the funding model is both fair and effective.

    He assured that the final report from the committee will be carefully reviewed before implementation.

    “Once it is produced, we will faithfully implement it and ensure that the funding model for the next cohort is fit for purpose and ensures that no student will be left behind,” he added.

    As the government moves forward with the necessary adjustments, it aims to create a more inclusive and equitable system for university funding, addressing the concerns raised by the court and ensuring that all students benefit from the policy.
